These Newspaper Website Terms of Use ("Terms") govern your access to and use of the newspaper websites, e-Editions, archives, newsletters, feeds, and mobile apps that eType Services, LLC ("eType," "we," "us") operates on behalf of its publisher customers and that link to these Terms (each a "Publisher Site"). Each Publisher Site belongs to the newspaper whose name appears on it (the "Publisher").
These Terms are an agreement between you, the Publisher of the Publisher Site you are using, and eType. The Publisher and eType may each enforce them.
These Terms apply to every Publisher Site that links to them, on every address at which it is available, including its pages, articles, photos, videos, e-Edition pages, archives, feeds (RSS and similar), sitemaps, newsletters, and any application programming interfaces.
A Publisher may post additional terms for its own Publisher Site, for example for subscriptions, contests, or comments. Those additional terms apply together with these Terms. If they conflict, the Publisher's additional terms control for that Publisher Site, except that nothing in them reduces the protections in Sections 3 through 10.
Our marketing website at etypeservices.com is governed by our separate Terms of Service. How we and the Publishers handle personal information is described in our Privacy Policy.
By accessing or using a Publisher Site in any way, whether as a person or through any software, service, crawler, bot, or other automated means, you agree to these Terms. If you are accessing a Publisher Site for or on behalf of a company or other organization (including through software that company operates), you agree on its behalf and represent that you have authority to do so, and "you" includes that organization.
If you do not agree to these Terms, do not access or use the Publisher Sites.
The news stories, headlines, photographs, graphics, video, audio, e-Edition pages, obituaries, listings, archives, data, page designs, and other material on a Publisher Site, and their selection and arrangement (together, "Content"), are owned by the Publisher or by the writers, photographers, news services, and other parties that license them to the Publisher. Some Content is owned by eType. The Content is protected by United States and international copyright, trademark, database, and other laws.
The newspaper's name, masthead, and logos are trademarks of the Publisher. eType does not own the Publisher's Content and does not license it to anyone.
Subject to these Terms, the Publisher grants you a limited, personal, non-exclusive, non-transferable, revocable license to:
Any other use requires the Publisher's prior written permission. All rights not expressly granted are reserved by the Publisher and its licensors.
Unless the Publisher has given you prior written permission, you may not, and may not allow, assist, or instruct anyone else to:
Search engines. General web search engines may crawl the publicly available pages of a Publisher Site to show links and short snippets in search results that send readers to the Publisher Site, as long as they follow the site's robots.txt file and these Terms. This permission does not extend to any other use of Content, including the uses described in Section 6, even by the same company.
Link previews. Social media and messaging services may fetch a single page when a person shares its link, only to display that link's title, summary, and image to the people it is shared with.
Unless the Publisher has given you an express, written license that specifically covers the use, you may not use any Content, in whole or in part, or any copy, extract, summary, translation, or derivative of it, to:
This Section applies to every person and organization, including any provider of search, social media, messaging, advertising, analytics, cloud, or other business services, and to Content obtained in any way, including through a crawler, a link preview, an advertising or analytics tool, a feed, a third-party dataset, a reader's account, or a copy made by someone else.
The Publisher and its licensors expressly reserve all rights in the Content to text and data mining, web scraping, and use for AI Systems. This reservation is made for the purposes of Article 4(3) of Directive (EU) 2019/790 and every similar law, regulation, or exception in any country, and is also expressed in machine-readable form in each Publisher Site's robots.txt file and, where available, its other machine-readable notices.
If a law permits a particular use of Content regardless of this reservation, nothing in these Terms limits that law; any use beyond what it permits remains subject to these Terms.
No license to Content is granted by implication, estoppel, or conduct. In particular, no license to use Content for any purpose in Sections 5 or 6 arises from:
A license to Content exists only in a written agreement signed by an authorized representative of the Publisher that expressly identifies the Content and the permitted use.
Each Publisher Site's robots.txt file, available at the root of the site (for example, /robots.txt), forms part of these Terms. Any automated access that does not follow the robots.txt file, or that disguises, misstates, or rotates its identity, network address, or user agent to avoid it, is unauthorized.
You may not bypass, disable, or work around any subscription paywall, story meter, login, rate limit, firewall, bot detection, access block, or other technical measure that protects a Publisher Site or its Content. The Publisher and eType may block, limit, or challenge any access at any time, without notice, including any automated access the Publisher has not permitted.
If you would like to license Content, including for syndication, research, or use with an AI System, please contact the Publisher using the contact details on its site, or contact eType at legal@etypeservices.com and we will forward your request to the Publisher. Each Publisher decides for itself whether to license its Content and on what terms.
Some Content is available only to subscribers. Subscriptions are sold by the Publisher on the terms shown when you subscribe. If you create an account or sign in, you are responsible for keeping your sign-in details confidential and for activity under your account. Your subscription and account are for your personal use; you may not share, sell, or transfer them, or use them to give anyone else, or any automated tool, access to subscriber-only Content.
The Publisher may suspend or end an account that is used in violation of these Terms.
If you submit material to a Publisher Site, such as a comment, letter to the editor, news tip, photograph, obituary, announcement, event, listing, or classified advertisement ("Submissions"), you confirm that you have the right to submit it and that it does not violate any law or anyone else's rights.
You keep ownership of your Submissions. You grant the Publisher, and eType acting on the Publisher's behalf, a worldwide, royalty-free, non-exclusive, perpetual license to edit, publish, display, distribute, and archive your Submissions in any of the Publisher's print, digital, and other publications, and to use them to operate and promote those publications. Once published, Submissions form part of the Content and are protected by these Terms, including Sections 5 through 9.
The Publisher decides what to publish and may edit, decline, or remove any Submission.
You agree not to use the Publisher Sites to:
Publisher Sites carry advertising, and may contain links to, or embedded content from, other websites and services. Those websites, services, and advertisers are responsible for their own content, products, and terms. Neither the Publisher nor eType endorses them or is responsible for them, and your dealings with them are solely between you and them.
If you believe material on a Publisher Site infringes your copyright, please follow the procedure in the DMCA copyright policy in our Privacy Policy.
Copying or using Content in violation of these Terms may infringe the Publisher's copyrights and other rights and may cause harm that money cannot adequately repair. In addition to any other remedy available by law, the Publisher and eType may seek an injunction or other equitable relief against any violation of Sections 5 through 11, in any court of competent jurisdiction.
Each Publisher is responsible for enforcing its own rights in its Content. eType may also take action to protect the Publisher Sites, the systems that run them, and the Content it operates on the Publisher's behalf, including by blocking access and preserving evidence.
The Publisher Sites and Content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the maximum extent permitted by law.
Neither the Publisher nor eType warrants that the Publisher Sites will be uninterrupted, secure, or error-free, or that Content is complete, current, or accurate at all times. News is reported as of the time it is published and may later change.
To the maximum extent permitted by law, neither the Publisher nor eType, nor their affiliates, directors, officers, employees, agents, or licensors, will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of, or inability to use, the Publisher Sites, even if advised of the possibility of such damages.
The total liability of the Publisher and eType together for all claims arising out of or relating to these Terms or the Publisher Sites will not exceed the greater of (a) the amount you paid the Publisher for a subscription in the twelve months before the claim arose, and (b) one hundred US dollars (US $100).
Some jurisdictions do not allow these limitations, so some may not apply to you. This Section does not limit liability for gross negligence, fraud, willful misconduct, or any liability that cannot be limited under applicable law. This Section does not limit any claim by the Publisher or eType against you.
You agree to defend, indemnify, and hold harmless the Publisher, eType, and their affiliates, directors, officers, employees, agents, and licensors from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your Submissions, your violation of these Terms, or your violation of any law or anyone else's rights.
These Terms are governed by the laws of the State of Texas and applicable United States federal law, including the U.S. Copyright Act, without regard to conflict-of-laws principles. The exclusive venue for any dispute arising out of or relating to these Terms or the Publisher Sites is the state and federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts. However, the Publisher may also bring a claim to protect its Content in the courts where the Publisher is located, and the Publisher or eType may seek injunctive relief in any court of competent jurisdiction.
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above. Changes take effect when posted, unless the update says otherwise. Your continued access to or use of a Publisher Site after an update takes effect means you accept the updated Terms. Changes do not apply retroactively to a dispute that arose before the change was posted.
Entire agreement. These Terms, the Privacy Policy, and any additional terms posted by the Publisher for its Publisher Site are the entire agreement between you, the Publisher, and eType about the Publisher Sites. A separate written license signed by the Publisher controls over these Terms for the Content and uses it expressly covers.
Severability. If any provision of these Terms is held unenforceable, the rest remain in effect, and that provision will be enforced to the maximum extent permitted.
No waiver. A failure to enforce any provision is not a waiver of it.
Assignment. You may not assign these Terms. The Publisher and eType may assign their rights under them.
Survival. Sections 3 and 5 through 22 survive any end of your use of the Publisher Sites.
